By accessing and using FacilityComplianceUS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
FacilityComplianceUS is a national registry and directory service that aggregates facility compliance and waste disposal service provider information from federal databases and other public sources. We provide a searchable platform for facility managers, compliance officers, and procurement teams.
3. Non-Agency Status
Important Disclosure
FacilityComplianceUS is a private entity and is not affiliated with, endorsed by, or a representative of any United States government agency, including but not limited to the Environmental Protection Agency (EPA), Department of Transportation (DOT), or Pipeline and Hazardous Materials Safety Administration (PHMSA).
4. Data Accuracy Disclaimer
While FacilityComplianceUS synchronizes with federal databases (EPA RCRAInfo, DOT FMCSA, PHMSA), we do not guarantee the real-time accuracy of official government records. Government agencies may update their records at any time, and there may be delays between official updates and our synchronization cycles.
User Responsibility: Users are responsible for final verification with primary federal sources before making operational safety decisions, entering vendor contracts, or relying on any information for regulatory compliance purposes.
5. Verification Status
Our platform offers different verification tiers for service providers:
- Standard Listing: Based on public federal records. No independent verification performed.
- Verified Provider: Based on a snapshot audit of licenses and insurance documentation at the time of verification.
- Featured Provider: Verified status plus additional profile enhancements.
Vendor Responsibility: Vendors with Verified or Featured status are contractually obligated to update FacilityComplianceUS of any changes to their licensing, insurance, or operating status to maintain their verified badge. Failure to do so may result in badge removal.
6. User Accounts and Profile Claims
To claim a business profile or access premium features, you must create an account and provide accurate information. By claiming a profile, you represent that you have the authority to act on behalf of the business entity.
By claiming a profile and making a payment, you agree to these Terms of Service and our Privacy Policy.
7. Fees and Payment
Some features of FacilityComplianceUS require payment. All fees are clearly disclosed before purchase. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.
8. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Scrape, harvest, or collect data from our platform without permission
- Submit false or misleading information
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Use automated systems to access the Service without our consent
9. Intellectual Property
The FacilityComplianceUS name, logo, and platform design are our intellectual property. The underlying public data from government sources remains in the public domain.
10. Limitation of Liability
To the maximum extent permitted by law, FacilityComplianceUS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Service.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim.
11. Indemnification
You agree to indemnify and hold harmless FacilityComplianceUS and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
